Welcome to John Dyer Gems. These Terms of Service ("Terms") govern your access to and use of the website www.johndyergems.com (the "Site") and any products, services, communications, or features offered by John Dyer & Co. ("John Dyer Gems," "we," "us," or "our").

By accessing the Site, placing an order, joining our waiting list, or enrolling in our SMS programs, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

2. Product Information & Pricing

We sell precision-cut colored gemstones. Because these are unique natural products, colors and appearance may vary slightly from photographs due to lighting and monitor calibration. We make every reasonable effort to display products accurately.

Pricing: All prices are in U.S. dollars and subject to change without notice.
Errors: We reserve the right to correct pricing errors and cancel orders placed at incorrect prices.
Warranties: We do not provide warranties regarding future investment potential or resale value.

3. Orders, Payment, Shipping, and Returns

Orders: Submitting an order constitutes an offer to purchase. Your order is accepted only when we send you a shipping confirmation email.

Payment: Payments are processed through third-party, PCI-compliant payment gateways. For international orders, you are responsible for any applicable customs duties, taxes, import fees, or other charges imposed by your country.

Shipping: Shipping costs and estimated delivery times are provided at checkout. Title and risk of loss pass to you upon delivery by the carrier.

Returns: We offer a 14-day return policy from the date of delivery. Items must be returned in their original condition. Some unique or special-order items may be non-returnable; any such terms will be communicated at the time of purchase.

By engaging with our specialized services, you agree to the following program-specific terms:

4.1 Gem Waiting List

Joining the list authorizes us to contact you when matching gemstones become available. This does not reserve a gemstone or guarantee a sale; all offers are typically first-come, first-served.

4.2 SMS / Text Message Program

We may send SMS/text messages for marketing purposes through Brevo. Consent is not a condition of purchase.

Marketing SMS: Recurring messages may include updates about new arrivals, product releases, sales, promotions, and other marketing communications.
Terms: Message and data rates may apply. Message frequency may vary. Text STOP to opt-out or HELP for assistance.
Privacy: We do not sell or share mobile information with third parties for their own marketing purposes.

4.3 Email Communications

By providing your email, you consent to order-related updates and, if opted-in, marketing emails. You may unsubscribe via the link in any marketing email.

5. Intellectual Property & User Conduct

Ownership: All content—including text, graphics, and gem-cutting designs—is the property of John Dyer & Co. StarBrite™ is a proprietary trademark. Unauthorized use of our trademarks or content may result in legal action.

Prohibited Use: You may not use the Site to violate laws, infringe on rights, transmit malware, or submit misleading information.

6. Legal Disclaimers & Liability

"As Is" Basis: THE SITE AND PRODUCTS ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT UNINTERRUPTED SERVICE.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOHN DYER & CO. SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS.

Indemnification: You agree to indemnify John Dyer & Co. against claims arising from your violation of these Terms or misuse of the Site.

7. Governing Law & Miscellaneous

Governing Law: These Terms are governed by the laws of the State of Minnesota. Any legal disputes shall be handled exclusively in the courts of Hennepin County, MN.

Severability: If any part of these Terms is found unenforceable, the remaining provisions stay in effect.

Changes: We may update these Terms by revising the "Effective Date." Continued use of the Site constitutes acceptance of new terms.
